1. Agreement to Terms

By accessing or using our website at ghiacdecus.com ("Site"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site or services.

2. Use of the Site and Services

2.1 Eligibility

If you engage our waste management services, additional terms may apply as specified in our service contract. In the event of any conflict between these Terms and the terms of a service contract, the terms of the service contract will prevail.

4. Intellectual Property Rights

4.1 Ownership

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by GhiaCDecus Waste Management, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to:

• Modify or copy the materials on our Site
• Use the materials for any commercial purpose or for any public display
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

4.3 Trademarks

The GhiaCDecus name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GhiaCDecus Waste Management or its affiliates. You may not use these marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

5. User Content

5.1 Submission of Content

Our Site may allow you to submit content, such as reviews, comments, feedback, or other materials. By submitting content to our Site, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

5.2 Content Standards

You represent and warrant that your content:

• Does not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights

NEITHER GHIACDECUS WASTE MANAGEMENT NOR ANY PERSON ASSOCIATED WITH GHIACDECUS WASTE MANAGEMENT MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE. WITHOUT LIMITING THE FOREGOING, NEITHER GHIACDECUS WASTE MANAGEMENT NOR ANYONE ASSOCIATED WITH GHIACDECUS WASTE MANAGEMENT REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

7. Limitation of Liability

IN NO EVENT WILL GHIACDECUS WASTE MANAGEMENT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

8. Indemnification

You agree to defend, indemnify, and hold harmless GhiaCDecus Waste Management, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your user content and any use of the Site's content, services, and products other than as expressly authorized in these Terms.

9. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be instituted exclusively in the courts of the Province of Ontario.

10. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
